1. Загальні положення
Цей документ є офіційною публічною пропозицією (офертою) Благодійної організації «Благодійний фонд Lumi Kids» (далі — Фонд), ЄДРПОУ 46305754, укласти договір про надання благодійної пожертви на умовах, викладених нижче. Документ адресовано необмеженому колу осіб (далі — Благодійник).
2. Терміни
- Оферта — ця пропозиція укласти договір.
- Акцепт — повне й безумовне прийняття оферти шляхом здійснення пожертви.
- Благодійна пожертва — добровільна безоплатна передача коштів на статутні цілі Фонду.
3. Предмет договору
Благодійник добровільно передає Фонду грошові кошти, а Фонд приймає їх і спрямовує на свою статутну благодійну діяльність — допомогу дітям (медицина, освіта, психологічна підтримка) та конкретні збори, оголошені на сайті.
4. Акцепт оферти
Акцептом є здійснення Благодійником платежу будь-яким із доступних на сайті способів. Акцепт означає, що Благодійник ознайомився й погоджується з умовами цієї оферти та Політикою конфіденційності. Реєстрація не потрібна.
5. Розмір і порядок пожертви
Розмір пожертви визначає Благодійник самостійно (фіксовані суми або власна сума). Пожертва може бути разовою або регулярною (щомісячною). Валюта — гривня; для міжнародних платежів — у валюті, доступній платіжного провайдера.
6. Регулярні платежі (підписка «Коло світла»)
Обираючи щомісячний внесок, Благодійник доручає провайдеру автоматичне щомісячне списання обраної суми. Скасувати або змінити підписку можна будь-коли — з листа Фонду або звернувшись на info@lumikids.org.ua, без пояснення причин.
7. Цільове використання та звітність
Фонд використовує пожертви виключно на статутні цілі. Якщо збір перевиконано, надлишок спрямовується на споріднену програму (про що зазначається на сторінці збору). Фонд публікує звіти на сторінці Звітність.
8. Повернення коштів
Благодійна пожертва є добровільною й поверненню зазвичай не підлягає. У разі помилкового платежу Благодійник може звернутися на info@lumikids.org.ua — Фонд розгляне звернення індивідуально згідно із законодавством.
9. Права та обов'язки сторін
- Фонд зобов'язується використати кошти за призначенням і звітувати публічно.
- Благодійник гарантує, що кошти належать йому на законних підставах.
- Фонд має право відмовити в прийнятті пожертви, якщо це суперечить його цінностям чи закону.
10. Безпека платежів і дані
Платежі обробляють сертифіковані провайдери (PCI DSS); Фонд не зберігає дані платіжних карток. Обробка персональних даних — згідно з Політикою конфіденційності.
11. Відповідальність і форс-мажор
Сторони звільняються від відповідальності за невиконання зобов'язань унаслідок обставин непереборної сили (форс-мажор) відповідно до законодавства України.
12. Строк дії та зміни
Оферта діє з моменту публікації й до її відкликання Фондом. Фонд може змінювати умови; актуальна редакція завжди розміщена на цій сторінці.

1. General provisions
This document is the official public offer of the Charitable Organization "Lumi Kids Charitable Foundation" (hereinafter — the Foundation), EDRPOU 46305754, to conclude a charitable donation agreement on the terms set out below. It is addressed to an unlimited number of persons (hereinafter — the Benefactor).
2. Terms
- Offer — this proposal to conclude the agreement.
- Acceptance — full and unconditional acceptance of the offer by making a donation.
- Charitable donation — a voluntary, gratuitous transfer of funds for the Foundation's statutory purposes.
3. Subject of the agreement
The Benefactor voluntarily transfers funds to the Foundation, and the Foundation accepts them and directs them to its statutory charitable activity — help for children (medicine, education, psychological support) and specific fundraisers announced on the site.
4. Acceptance of the offer
Acceptance is the Benefactor making a payment by any method available on the site. Acceptance means the Benefactor has read and agrees to the terms of this offer and the Privacy policy. No registration is required.
5. Amount and procedure of the donation
The Benefactor sets the amount independently (fixed amounts or a custom amount). A donation may be one-time or recurring (monthly). The currency is the hryvnia; for international payments — in a currency available from the payment provider.
6. Recurring payments ("Circle of Light" subscription)
By choosing a monthly contribution, the Benefactor authorizes the provider to automatically debit the chosen amount monthly. You can cancel or change the subscription anytime — from the Foundation's email or by writing to info@lumikids.org.ua, without giving reasons.
7. Targeted use and reporting
The Foundation uses donations solely for statutory purposes. If a fundraiser is over-funded, the surplus goes to a related program (as stated on the fundraiser page). The Foundation publishes reports on the Reports page.
8. Refunds
A charitable donation is voluntary and is generally non-refundable. In case of an erroneous payment, the Benefactor may write to info@lumikids.org.ua — the Foundation will consider the request individually in accordance with the law.
9. Rights and obligations of the parties
- The Foundation undertakes to use the funds for their purpose and to report publicly.
- The Benefactor guarantees that the funds belong to them on legal grounds.
- The Foundation may refuse a donation if it contradicts its values or the law.
10. Payment security and data
Payments are processed by certified providers (PCI DSS); the Foundation does not store payment card data. Personal data is processed in line with the Privacy policy.
11. Liability and force majeure
The parties are released from liability for failure to fulfill obligations due to force majeure circumstances in accordance with the legislation of Ukraine.
12. Validity and changes
The offer is valid from the moment of publication until it is withdrawn by the Foundation. The Foundation may change the terms; the current version is always on this page.
